Terms of Service for Mrs. Mobile Notary

Before you start using our platform, please take a moment to read through our Terms of Service. By accessing or using our website and services, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our services, and we do not approve that you use the Website.
Acceptance of Terms: By accessing or using Mrs. Mobile Notary ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and any other guidelines or rules applicable to specific features or services.
User Eligibility: Users must be at least 18 years old and capable of entering into a legally binding agreement to use our services. By using the Service, you affirm that you are of legal age.
Services Provided: Mrs. Mobile Notary facilitates the scheduling of mobile notary services. We connect users with experienced and certified notaries to assist with document notarization and ensure compliance with relevant laws and regulations governing notaries.
Quote Requests: Users have the option to request a quote through the Website, call, email, or text for notary services before scheduling an appointment. Quotes will be provided via email and are estimates subject to change based on the specific details of the notarization service required.
Appointments:
a. Appointments for notary services are only considered confirmed when payment is made. Users must pay at least a the travel fee as a deposit or the full amount at the time of scheduling the appointment.
b. Unpaid appointments will be held as valid for a period of 2 hours from the scheduled time. If the required deposit has not been made or the full payment has not been received within this 2-hour window, the appointment will be considered canceled, and the time slot may be made available to other users.
c. It is the responsibility of the user to ensure timely payment to confirm their appointment. Mrs. Mobile Notary will not be liable for any inconvenience or loss resulting from failure to make timely payments.
Fees and Payments: Users may be required to pay fees for the notary services provided. All fees and payment terms will be clearly communicated before the service is scheduled. A deposit for travel fee is required to confirm the appointment, and final payment is due upon completion of the notarization service, or users have the option of full payment in advance.
Incidental Expenses and Refund Policy: Upon the completion of the service, any incidental charges accrued to provide the complete service, such as those for extra stamps, parking fees when required, road tolls, etc., will be due immediately. Any credits owed to you will be promptly refunded on the same day.
Refund Policy: We understand that circumstances may arise requiring adjustments to your payment. Our refund policy is as follows: Cancellation and Refund Eligibility:
a. If you cancel an appointment within 24 hours or more of the scheduled time, you may be eligible for a 50% refund, depending on the specific circumstances.
b. If you cancel an appointment within 48 hours or more of the scheduled time, you will be refunded 100% of your payment.
Unfulfilled Appointments: In the rare event that Mrs. Mobile Notary is unable to fulfill a scheduled appointment, a full refund of 100% will be issued to you.
Erroneous Charges: If you believe there has been an error in the charges incurred, please contact us promptly for a thorough review. Erroneous charges deemed valid will not be eligible for a refund.
Refund Process: Refunds, if applicable, will be processed using the same method as the original payment. Please allow a reasonable processing time for the refund to reflect in your account.

Failure to Provide Accurate Information
Refund and Cancellation Policy. No refund will be issued if:
Lack of Legal Capacity: If one or more parties involved in the notarization process lack legal capacity to execute a document, a refund may not be issued.
No Valid Identification: If one or more signatories do not possess the state-required identification necessary for notarization, a refund may not be provided.
Short-Notice Cancellation/Reschedule: If an appointment is canceled or rescheduled with less than the specified notice period (e.g., 24 hours) before the scheduled appointment, a refund may not be issued.
Post-Reschedule Refunds: After a successful rescheduling of an appointment, a refund may not be issued, as the service has been accommodated for the client's convenience.
Completed Notarization: Once the notarization service has been successfully completed and documents have been notarized, a refund may not be applicable.
Failure to Provide Accurate Information: If a client provides inaccurate or incomplete information during the registration or appointment scheduling process, leading to additional costs or issues, a refund may not be granted.
Wait Time Clause: In the event of delays caused by the client:
The notary will wait for a maximum of 60 minutes beyond the scheduled time for the client's arrival.
Charges for Extended Wait Time: Clients will be billed $37.50 every 30 minutes of wait time.
Exceeding Wait Time: Should the client fail to arrive within the specified wait time, the notary reserves the right to deem the appointment canceled.
Communication of Delays: Clients are encouraged to communicate promptly with the notary in the event of unforeseen delays. Failure to notify the notary of delays may result in the cancellation of the appointment after the designated wait time.
Remaining Balance Payment Terms: To facilitate the provision of our services, clients are required to provide credit card information. By scheduling an appointment and providing credit card details, clients consent to allowing us to charge any outstanding amounts uncollected at the time of service. The entire balance for services rendered is due at the time of service completion.
User Conduct: Users agree not to use the Service for any unlawful or prohibited purpose. Harassment, abuse, or any form of misconduct towards notaries or other users will not be tolerated.
Prohibitions: Users agree not to use the Service for any unlawful or prohibited purpose. This includes but is not limited to committing criminal offenses, transmitting malicious software, or infringing upon the proprietary rights of others.
Intellectual Property, Software, and Content: The content available on the Mrs. Mobile Notary, including text, graphics, logos, and images, is the intellectual property of Bay State Notary. Users may not use, reproduce, or distribute any content without the express written consent of Mrs. Mobile Notary.
Privacy: Our Privacy Policy outlines how we collect, use, and disclose your personal information. By using the Service, you agree to the terms of our Privacy Policy.
Limitation of Liability: Mrs. Mobile Notary and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Termination: Mrs. Mobile Notary reserves the right to terminate or suspend your account at any time without prior notice for any reason.
Changes to Terms: Mrs. Mobile Notary reserves the right to update or modify these Terms of Service at any time without prior notice. Users are encouraged to review the terms periodically.
By using Mrs. Mobile Notary, you acknowledge that you have read, understood, and agreed to these Terms of Service.
